These Terms of Use govern your use of TrapScan. By using the service, you agree to them. If you don't agree, don't use TrapScan.
About TrapScan
TrapScan is community trapping software operated by me, Kurtis Papple, a sole trader based in New Zealand. It helps people record trap checks and shares conservation data with Trap.nz. Project, trap and catch records are kept in both systems, with Trap.nz serving as the authoritative source and long-term archive.
Acceptable use
You may:
- record checks for traps you're authorised to check;
- view project data you have access to;
- use TrapScan for legitimate conservation purposes.
You may not:
- record false or misleading data;
- access traps or projects without authorisation;
- attempt to hack, overload or otherwise abuse the service;
- resell or sublicense access to TrapScan without permission;
- scrape data or reverse-engineer the service.
Accounts
If you have a TrapScan account, keep your password secure, don't share your account credentials, and email contact@trapscan.app if you suspect unauthorised access.
I may suspend or terminate accounts that violate these terms.
Project manager responsibilities
If you manage a TrapScan project, you're responsible for:
- distributing and managing TrapScan Cards;
- controlling access to traps;
- paying the annual project subscription;
- ensuring that data recorded for your project is accurate.
Data
For the purposes of TrapScan, conservation data recorded for a project, including traps, trap checks and catch records, belongs to the person designated as that project's owner in TrapScan. The project owner grants me, as the operator of TrapScan, a non-exclusive, royalty-free licence to use that data to:
- host it;
- aggregate it and display it on the public project dashboard and the network-wide dashboard;
- sync it to Trap.nz;
- do anything else reasonably needed to operate TrapScan, for conservation purposes, or for compatibility with Trap.nz.
TrapScan keeps a copy of conservation data so the application can operate and display it. This copy is kept largely in sync with Trap.nz, which is the authoritative source and enduring conservation archive. Data held by Trap.nz is subject to its own terms and policies, including its access rules. A trap marked private in TrapScan can still be located by members with permission to view it in Trap.nz, as explained in the Privacy Policy.
TrapScan also keeps its own operational data, including card information and account details, to support the service. Your personal account information, such as your name and email address, belongs to you.
Service availability
I aim to keep TrapScan available and reliable, but I can't guarantee uninterrupted access. I may temporarily suspend the service for maintenance and will try to give notice of planned outages.
Trap check recording works offline.
Fees
- A project subscription costs $108 NZD per year, per project, including GST.
- TrapScan is free for volunteers.
- The first pack of 25 TrapScan Cards is free during a project's first paid subscription year, with postage charged separately. Additional cards cost $1 NZD each, including GST, and are sold in packs of 25 for $25 NZD, plus postage.
Limitation of liability
TrapScan is provided "as is", without warranties.
If you acquire TrapScan in trade for business purposes, you and I agree that the Consumer Guarantees Act 1993 does not apply, but only where both of us are in trade, this exclusion is agreed in writing, and it is fair and reasonable for us to be bound by it. This exclusion does not apply to volunteers or individuals using TrapScan personally. Nothing in these terms excludes or limits any rights under that Act that cannot lawfully be excluded or limited.
To the maximum extent permitted by New Zealand law, I'm not liable for:
- lost or corrupted data;
- service interruptions;
- decisions made using TrapScan data;
- damage to traps, property or wildlife;
- how people you've given TrapScan Cards to use them.
To the maximum extent permitted by New Zealand law, my total liability is limited to the fees you've paid me in the previous 12 months.
Changes to these terms
I may update these terms from time to time. I'll notify registered users about significant changes. If you continue using TrapScan after the updated terms take effect, you accept them.
Ending your use of TrapScan
You can stop using TrapScan at any time. I may terminate your access if you violate these terms. Data already synced to Trap.nz remains there.
Governing law
These terms are governed by New Zealand law. Any disputes will be resolved in New Zealand courts.
